Terms of Service

These terms govern your use of thefourthturningleader.com and the Code Lab application, operated by Christopher Myers.

1. Acceptance of Terms

By accessing thefourthturningleader.com or using the Code Lab application (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all visitors, subscribers, assessment takers, Code Lab users, cohort participants, and organization clients. Christopher Myers reserves the right to update these terms at any time. Continued use after any update constitutes acceptance of the revised terms.

2. Nature of the Platform — Educational and Reflective Use Only

The Fourth Turning Leader and the Code Lab are educational and reflective tools. They are designed to help leaders examine their values, decision patterns, and leadership practice. The Platform does not provide: • Legal advice of any kind. • Financial, investment, or tax advice. • Medical, therapeutic, psychiatric, or counseling services. • Compliance, regulatory, or employment law guidance. • Professional advice of any other kind. Nothing on this Platform — including book content, framework materials, assessment results, AI-generated outputs, facilitator commentary, cohort discussion, or any other communication — constitutes professional advice or establishes a professional advisory relationship of any kind. You remain solely responsible for every decision you make and its consequences, regardless of what the Platform, its tools, or its AI outputs suggest.

3. User Responsibility for Decisions

The Code Lab provides structured reflection prompts, decision memo scaffolding, and AI-assisted language tools. These are aids to your own thinking. They are not substitutes for professional judgment, legal counsel, financial advice, or any other form of expert guidance. By using the Platform, you acknowledge and agree that: • You remain fully responsible for every decision you make. • The Platform does not and cannot evaluate the legal, financial, regulatory, or strategic merits of your situation. • AI outputs may be incomplete, incorrect, biased, or contextually inappropriate. You should not rely on them as fact or as professional guidance. • Results and outputs from the Platform are for your private reflection and development, not for use as authoritative records in legal, financial, or regulatory contexts.

4. What You May Not Submit

You may use the Code Lab to reflect on your own leadership experience and decisions. You may not submit: • Information protected by attorney-client privilege or any other legal privilege. • Protected health information (PHI) regulated under HIPAA or equivalent laws. • Material nonpublic information (MNPI) regulated under securities laws. • Confidential information belonging to a third party unless you have clear authority to share it in this context. • Information subject to non-disclosure agreements that prohibit sharing with third-party platforms. • Personally identifiable information about third parties without their knowledge. If you are unsure whether information is appropriate to submit, do not submit it. Consult qualified counsel first.

5. AI Outputs

The Code Lab uses AI for reflection prompts and language analysis tools within the private application. These are designed to support self-examination, not to produce authoritative outputs. AI outputs may be incomplete, incorrect, biased, or contextually inappropriate. You should not rely on them as fact or as professional guidance.

6. Private App Data

Your Code Lab account data — including your honor code drafts, decision memos, shadow audit entries, journal records, and transmission plan — is private to your account by default. • Other users cannot see your private data. • Organization administrators cannot see your raw individual reflections by default (see Section 7). • Cohort facilitators see only what you explicitly submit as a cohort deliverable (see Privacy Policy Section 9). • You may export your data at any time. See the Privacy Policy for data retention and deletion terms. We take reasonable technical and organizational measures to protect your account data. However, no digital system is fully secure, and we cannot guarantee absolute protection against unauthorized access.

7. Organization Aggregate Reporting

If your organization has arranged a group engagement: • Organization administrators and facilitators receive aggregate reports showing team-level patterns — for example, mode distribution or shadow themes — not individual raw responses. • Individual attribution in any report requires your explicit consent. • Any departure from this default requires disclosure before you begin the engagement and your affirmative agreement. Organizations that misuse aggregate reporting data, or that attempt to use it for employment decisions without proper disclosure and consent, do so in violation of these terms and without authorization from the Platform.

8. Payments, Refunds, and Cancellations

Payments on this Platform are active and are processed by Stripe. • Prices, billing intervals, applicable taxes, discounts, and shipping charges (where applicable) are shown at checkout before you confirm a purchase. • Full card details are entered into Stripe and are not stored by this Platform. We retain transaction metadata such as amount, date, product or plan, payment status, and Stripe customer/session/subscription identifiers for accounting, access control, fulfillment, fraud prevention, dispute handling, taxes, and support. • Subscriptions renew automatically at the stated interval until cancelled. You can manage your subscription, update payment method, view invoices, or cancel renewal through the Stripe billing portal in your account settings, or by contacting chris@bsidecapital.com. • Cancellation stops future renewals. Unless otherwise required by law or specified in a written offer, cancellation does not automatically create a retroactive refund for the current billing period. • Refunds are evaluated on a case-by-case basis unless a specific written offer says otherwise or applicable law requires otherwise. • Cohort seats, founding pricing, and early access pricing may be limited and may be discontinued for future purchasers at the sole discretion of Christopher Myers. • If you have a billing dispute, please contact chris@bsidecapital.com before initiating a chargeback so we can attempt to resolve it directly.

9. Acceptable Use

By using this Platform, you agree to: • Use it only for lawful purposes and in a manner consistent with all applicable laws. • Not attempt to gain unauthorized access to any part of the Platform or another user's account. • Not reverse engineer, scrape, or systematically extract content from the Platform for commercial purposes without written permission. • Not submit false, misleading, or fraudulent information. • Not use the Platform to harass, defame, or harm any person. • Not submit content that infringes any intellectual property right or violates any applicable law. We reserve the right to suspend or terminate access for any violation of these terms.

10. Intellectual Property

All content on this Platform — including text, frameworks, diagrams, assessments, course materials, and design — is the intellectual property of Christopher Myers and The Fourth Turning Leader, unless otherwise noted. You may share brief excerpts for non-commercial purposes (reviews, educational discussion, social media) with proper attribution. You may not reproduce, republish, or distribute substantial portions without written permission. The Five Modes framework, The Fourth Turning Leader series name, and associated models are proprietary. Requests for licensing or educational use should be directed to chris@bsidecapital.com.

11. Limitation of Liability

To the fullest extent permitted by law, Christopher Myers and The Fourth Turning Leader shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use this Platform, including damages resulting from decisions you made in connection with using the Platform or its tools. Third-party links (including Amazon and other external services) are provided for convenience. We are not responsible for the content, accuracy, or practices of those services.

12. Governing Law

These Terms of Service are governed by the laws of the State of Arizona, United States of America, without regard to conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.
